Man Charged in Last Week's Avondale Shooting
Gutierrez, a prior parolee, last arrested in the 16th district after foot chase (VIDEO), was charged with one count of aggravated battery.
A man was charged in the shooting of a 37 year-old man last week, Saturday, January 28th on the 3600 block of W Belmont.
Rudy Gutierrez, 32, was charged with one felony count of Aggravated Battery - Discharge Firearm for his involvement in the shooting. The shooting is said to have started near Los Potrillos Food Market after Gutierrez and a co-offender are said to have gotten into a verbal argument.
Gutierrez appeared in Bond Court this afternoon. Prosecutors did not state that Gutierrez is accused of possessing or firing the gun used in this shooting. Prosecutors did say that Gutierrez is accused of participating in the incident after he walked up to the victim and asked him where he was from. During the bond hearing, it was revealed that Gutierrez called police and turned himself into the 25th District Chicago Police station. Bond was set at a $150,000 d-bond, meaning Gutierrez will need to post 10% of $150,000 or $15,000 to be released from Cook County Jail.
Gutierrez has been seen on the 16/17th District Police Scanner in the past. In April 2020, Gutierrez, then 29 years-old, was arrested for possession of a stolen firearm. According to a Chicago Police report, the 16th district tactical team was monitoring a Latin Kings gang funeral on the 5600 block of W Irving Park. Police then received a call of a person with a gun. When police arrived, Gutierrez grabbed his waistband and began to run through a gangway and starting a foot pursuit. Police were able to catch up to him and located a Ruger LCP .380 caliber with an extended magazine that was reported stolen. Gutierrez was charged with possession of a stolen, unlawful use of a weapon and reckless conduct in that case.
The status of that 2020 case was not immediately available.
